BART notice deadline

BART must receive a written claim for damages within 6 months of the accident date. This rule comes from Cal. Gov. Code § 911.2(a).

Time limit for filing a lawsuit

After BART rejects the claim in writing, the lawsuit must be filed within 6 months of that letter. When no written answer ever arrives, 2 years counted from the accident is the limit. That time limit is set by Cal. Gov. Code § 945.6(a).

Filing a claim with BART

Use BART, P.O. as the mailing address for Form 1020, BART's claim form. Box 12688, Oakland, CA 94604-2688, Attn: Insurance Division. The form's three copies all return to BART. Official page.
